In order to properly pay FLSA overtime premium, employers must understand and apply the FLSA “regular rate” provisions for non-exempt employees who receive bonus, commission or most other forms of pay along with their base hourly rate. The FFCRA also incorporates these regular rate rules, with some variations, for computing paid time off for non-exempt employees.
